Oh I posted this due to reading that "warm start" thread recently .. I've had a couple of instances myself and there's 1500km only on the clock.

Thanks Adz! So you are having the warm start issue! That's a bugger. Try and video your warm starts until you capture an offending one then jump on them for new injectors.

Tell 'em Dazzler from the i30 Owners Club will have their guts for garters if they don't look after you and you end up going back to Mazda!  :evil: :crazy1:

EDIT: 280K for a Range Rover! Was it gold plated!  :crazy1:

Problem is how much did they spend to get the result.

The regulator should have stepped in long before this and ensured the law was upheld.

I think what Beerman is saying is not everyone has the resources to fight that hard, irrespective of whether they will get it back or not. It was great they did this though. Hopefully others won't have to spend near that much now a precedent has been set.  :goodjob2:

Yes I did, they spent 140k on legals, the dealer spent 150k and Jag spent 100k.

When you play these games, if you lose you pay the winners costs, hence had they lost, not only would they have been up for their 140k but another 250k in costs from the winners. Which is a big price to pay for a 280k car, most would just get it running and take a bath on the trade in.

Now they won, so they got their refund and (no doubt friend who is a lawyer and wouldnt have charged them nearly as much had they lost) got 140k. But to common folk buying a 20-60k car the stakes are far too high.

Just think,  that was one car.
If anyone else had that problem, with any brand,  the precedent has been set.
The Australian Consumer Law is amongst the toughest in the world, that's great for Aussie's.
The "not suitable for purpose -driving on OR off road " is now LAW. So is the related Saftey aspect.
So now if you  have dramas with any brand and the individual car cannot meet its legaly defined "purpose ", safely,  then you are on a winner .
It will be interesting to see if people start having "Class  Action" against  the manufacturer & dealer when they know that a particular model has a common problem that is not being rectified.  I'm sure that one of the well advertised law firms would take the case.
People need to stand their ground.
