Signing Liability Forms Before a Test Drive

We're looking at new cars. So far, we've test driven/ridden a Prado, Pajero and Jeep. In all but one case the salesperson wanted to either look at my licence, which is fair enough, or to sign a form that says that I accept all responsibility for damages occuring to the vehicle.

Anyway, with this one dealer, the form was quite lengthy and with the bottom line of a $1,500 liability should the car be damaged, my fault or otherwise.

I said to the sales person that it was unacceptable - that I wasn't going to expose my arse for the sake of a test drive of a product that she wanted to sell me. I said that we'd go for a ride, at least to see how it felt and sounded (it was the Jeep Grand Cherokee).

One other time, 8 years ago, test driving a Mazda Tribute, the guy wanted me to sign the 3 page form, the bottom line of which that I'd be up for ALL damages, regardless of who's at fault. In that instance I said "no thanks" and walked out. The salesman followed me and capitulated. He drove it out of the dealership then pulled over down the road and let me drive it around the block and back again.

I'm just wondering what other peoples' experiences are in this.

Same thing happened earlier this year when I went to check out a new motorcycle. The bike wasn't even registered. I'd be wearing a trade plate over my shoulder. It had no insurance other than what the trade plate covers for third party. Again, I walked away from that one.

I'm of the view, rightly or wrongly, that if a dealership wants to sell me a car and for me to want to buy that car then they should "self insure", so to speak, so I can test drive it.

Must be a lot of wild test rides there?
But agree I would not take that .
I have test ridden a lot of motorbikes in my time but never with a trade plate over my sholder they register them here & must sell as demonstrators, at least the dealer I mostly go to.
My friend & I ( I was passenger ) took a new Ford Focus for a test drive in a country town NSW the salesman drove car out showroom floor said take it for a test drive did not look at licence we parked my car out front.

I'm with you. No way I'd agree to those sorts of terms.
When I bought the i30, I drove it quite some distance, told the salesman I didn't want to go on his normal route, but wanted to get up into some hilly and twisty stuff. He agreed. That afternoon when I took my wife back to see the car, he let us take it by ourselves.
Lately I've developed a dislike of the licence photocopy thing they do these days. I've decided that if I test drive a car again and they want that, I'll only agree to it on the proviso they give me back the copy at the end of the test. Identity theft is becoming rife and I don't intent to make it easier for anyone.

Wow good point Trev about the identity theft (although they might just take 2 copies)  :whistler:

I find most places over here just take a copy of your licence and some get you to sign the photocopy with a time on it.

I have mixed feelings about the places that make it too easy for you to take the car by yourselves (especially if it is the actual car you are interested in)

You don't know how the last unsupervised person treated it!  :sweating:

I am happy to not sign anything and have the salesperson come with us.  :cool:

I wouldn't be happy with a liability clause!

I always watch if anyone wants a copy of my licence - or if I use a credit card. Although generally these days you insert the card into the reader yourself.

Being Tassie , I mostly know the guys I am dealing with personally. Not related though!  :evil:

Not with MY licence they won't. I followed them into a back room once.

Dazz salesman who let me & a friend take a new ford focus manual for a tst drive did not want his licence so, no problem taking that car it came off showroom floor, most genuine salesperson i've meet in life. did not try to push a sale. friend tested the Focus petrol bought a new i30 CRDi Diesel, was a very hilly area, big mountains the diesel showed up the petrol lack of Torque.

When we were buying the i30 we took about 4 different i30s for a drive. petrol man/auto, diesel man/auto. No licence photocopying, form filling or arse baring. Each time the sales person came with us and we drove around a fair bit.

The same dealership let us drive the Prado last week without this, just sighting of the licence.
