A TOWNSVILLE man has copped a $146 fine for driving 1km/h over the speed limit.

Jake Cassidy, 21, was pulled over on December 23 and accused of clocking 61km/h in a 60km/h zone.

Mr Cassidy was driving a company car on a delivery and is not convinced he was 1km/h over.

The police officer did not use a speed gun to catch Mr Cassidy but measured the speed by driving behind him.

I find it difficult to believe, the Australian Road Rules requires your speedometer to be accurate to plus or minus 10%. :confused:

In my police radar operator days, we always gave a minimum 10% tolerance on speed enforcement, for that very reason, who wants to spend every day in court or answering complaint files. :(

i.e. 60 km/h area, radar set on 66 km/h.   80 kmh area set on 88, they were the minimum tolerances. :victory: Talking about the State of New South Wales here. (The Premier State !) :razz:

I thought they take off 4ks to account for the fact your speedo may be out. So if that was the case, this guy was actually going 65ks in a 60 zone, which is speeding.

In WA tolerances are built in to the speed detection devices of either 1 or 2 km/h and that is already taken off when you get the reading.
As far as a check speed goes (following behind) there is no way anyone would be charged in WA with 1 km/h over. 
I feel there might be more to that story than is reported.
Even if a police officer did charge someone that way and submitted the brief, every supervisor I know would cancel it before it went to court.
And if for some reason all of that failed, the Police Prosecutor would refuse to prosecute it.
It's ridiculous and as I said, something smells of fish.......
The 10 per cent days are gone over here, as speed cameras are set at tolerances of @ 6 km/h over the limit in all speed zones.

Plus a follow and check speed is relying on the speedometer of the police car and the skill and judgement of the police driver, not gaining nor falling away from the offending vehicle.  We had special speedos fixed to traffic cars in NSW, which were calibrated and tested on the masterhead of a similar device monthly.  Even so, I would not issue a notice for less than 15 km/h over the limit on a checked speed, too hard to prove.  But these days, better traffic technology. :D

Assuming the police speedo was that accurate, this equates to EITHER DRIVER NOT varying their separation from each other by 277~ millimetres, (less than 1 foot), per second over the speed test period, absolute and utter rubbish. They couldn't do it if they tried.  :fum:

Just throwing it out there. Copper sees a car going fast, pulls him over, says to old mate how fast were you going? Old mate, being a smart ass said 61 Copper says ok, from my observation you were going faster than that, but since you say 61, and I only have to prove you exceeded the limit so be it.
