Unbelievable

Magistrate's comments are deplorable.

Magistrate Steven Malley's statement that "it was a sad day" that he had to jail a woman for biting and punching a female police officer as his hands were tied, has angered many people and has pushed back the cause of people being responsible for their own actions and accepting the consequences of these actions.

"It is a sad day when you have to send someone to jail that is of good character," Magistrate Steven Malley said.

Just another example of a pansy arse wuss of a judge. What happened to you do the crime you do the time? I dont give a shit how good someones "character" is, she obviously did something pretty bad to be getting tied up in the first place then to continue by assulting the copper is ridiculous. Judge should go in with her.

You must be importing magistrates from the UK... I know of a case locally where a youth was fined £50 by magistrates for spitting in the face of a police officer.

Meanwhile, driving at 36 in a 30 limit carries a £100 fine and 3 penalty points... :wacko:

I'm not a fan of mandatory sentences but in this case the sentence seems to have been justified...  :undecided:

Amnesty International should know better.

Criminals are forever using family histories as mitigating circumstances. ie. diminished responsibility to try and weasel their way out of being made responsible for their actions.

I was drunk, or I was drug affected do not cut it as excuses. Everyone knows what drugs (alcohol is a drug) do to you. So, if you go on a bender knowing that you'll become violent, if anything, further amplifies your guilt.

In the case of this woman who assaulted the police member, I don't know if she was drunk, sober, on ice or whatever. But she did the crime, now she has to do the time.

I'll bet anything that if this magistrate became a victim of crime that he'd do anything possible to see the perpetrators serve the maximum possible time. If we had a judiciary who believe in punishments fitting the crime then there wouldn't be a need for mandatory sentencing.
